Terms of Service for AIM Lift

Welcome to AIM Lift (“the App”), developed and operated by an independent individual developer (“we,” “us,” “our”), not a company. By creating an account, you confirm that you accept these Terms of Service and our Privacy Policy. If you use the App without an account, your use of the App is also subject to these Terms.

Use of the App

AIM Lift is a workout tracking application. You may use it to log, track, and review your exercise activity. You must be at least 13 years old to use the App, and by creating an account you confirm that you are.

You are responsible for maintaining the accuracy of the information you enter and for keeping your account credentials secure.

Exercise & Health Disclaimer — Please Read

AIM Lift is a tracking tool, not a medical or fitness professional. The App does not provide medical advice, diagnosis, or treatment, and nothing in the App should be interpreted as such.

• Consult a physician or qualified healthcare provider before beginning any exercise program, particularly if you have any pre-existing health condition, injury, or concern.
• Exercise carries inherent risk of injury. You assume full responsibility for your own safety when performing any exercise, whether or not it is logged, suggested, or referenced within the App.
• Stop exercising immediately and seek medical attention if you experience pain, dizziness, shortness of breath, or any other concerning symptom.
• We are not liable for any injury, loss, or damage arising from your use of the App or your participation in any exercise activity.

Your Content

You retain ownership of the workout data you enter into the App. By using the App, you grant us the right to store and process that data solely to provide the App’s functionality (see our Privacy Policy for details).

Account Termination

You may delete your account at any time from within the App. We reserve the right to suspend or terminate accounts that violate these terms or misuse the App.

Disclaimer of Warranties

The App is provided “as is” without warranties of any kind, express or implied. We do not guarantee the App will be uninterrupted, error-free, or that any data will never be lost — while we take reasonable steps to protect your data (including cloud backup for account holders), you’re encouraged not to rely on the App as your sole record of critical information.

Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the App, including but not limited to injury sustained while exercising.

Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of another party.

Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the App will be resolved in the state or federal courts located in California, and you consent to that venue.

Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the updated Terms. Material changes will be reflected by updating the “Last updated” date above.
